Bachelet urges Guatemalan Government to guarantee democratic freedoms and institutions

GENEVA (14 January 2019) – Ahead of the demonstrations expected in several Guatemalan cities today and tomorrow, the UN High Commissioner for Human Rights Michelle Bachelet on Monday urged the Guatemalan Government to guarantee freedom of expression and opinion, and the right to peaceful assembly and association.

"Freedom of expression, without fear of reprisals and intimidation, is the backbone of democracy," Bachelet said. "A culture of human rights and peace is strengthened when diverse social groups can express themselves in the public space and freely exercise their rights."

The demonstrations have been organized by various sectors of civil society to protest on a variety of issues including the Government's decision to unilaterally terminate the agreement with the UN on the establishment and work of the International Commission against Impunity in Guatemala (CICIG).

The High Commissioner also expressed great concern about the apparent further erosion of various State institutions, including the recent attacks on the independence of the Constitutional Court.

"I would also like to stress that it is essential to guarantee the rule of law, judicial independence and impartiality and respect for democratic institutions, particularly the Constitutional Court, the judiciary, the National Human Rights Institution, the Public Prosecutor's Office and the Electoral Tribunal," the High Commissioner said.

The UN Human Rights Chief stressed that these institutions and their officials play a crucial role in respecting and guaranteeing human rights, the rule of law and democracy.

"The proper exercise of their functions is fundamental in the current context and for the general elections to be held in the coming months. Respect for their safety and their physical integrity, as well as that of their families, must be guaranteed by the State of Guatemala in compliance with its international human rights obligations," she said.

The High Commissioner said she and her Office in Guatemala are ready to continue to support the State authorities in fulfilling their international human rights obligations and commitments.

Bachelet exhorta al Gobierno de Guatemala a garantizar libertades e instituciones democráticas

GINEBRA (14 de enero de 2019)- Ante las manifestaciones que se han anunciado en varias ciudades de Guatemala en la jornada de hoy y de mañana, la Alta Comisionada de las Naciones Unidas para los Derechos Humanos, Michelle Bachelet, exhortó el lunes al Gobierno guatemalteco a garantizar la libertad de expresión y opinión, y el derecho a la reunión pacífica y de asociación.

“La libertad de expresión, sin temor a represalias e intimidación, es la columna vertebral de la democracia”, subrayó Bachelet. “Una cultura de derechos humanos y de paz se fortalece cuando diversos grupos sociales pueden expresarse en el espacio público y ejercer sus derechos libremente” añadió.

Las movilizaciones han sido convocadas por diversos sectores de la sociedad civil, entre otros asuntos, en protesta por la decisión gubernamental de terminar unilateralmente el convenio con la ONU sobre el establecimiento y labor de la Comisión Internacional contra la impunidad en Guatemala (CICIG).

Asimismo, la Alta Comisionada mostró su gran preocupación por la aparente erosión a la que han sido sometidas diversas instituciones del Estado, particularmente los recientes ataques a la independencia de la Corte Constitucional.

“Quisiera también resaltar que es esencial garantizar el Estado de Derecho, la independencia e imparcialidad judicial y el respeto a las instituciones democráticas”. “Especialmente la Corte de Constitucionalidad, el estamento judicial, la Institución del Procurador de los Derechos Humanos, el Ministerio Público y el Tribunal Supremo Electoral", añadió la Alta Comisionada.

La máxima responsable de Derechos Humanos de la ONU destacó que estas instituciones y sus funcionarios cumplen un rol crucial para el respeto y garantía de los derechos humanos, el imperio de la ley y la democracia.

“El adecuado ejercicio de sus funciones es fundamental en el contexto actual y en las elecciones generales que tendrán lugar en los próximos meses. Su seguridad y el respeto a su integridad física, así como la de sus familias, deben ser garantizados por el Estado de Guatemala en cumplimiento de sus obligaciones internacionales en materia de derechos humanos”, puntualizó.

En este sentido, la Alta Comisionada y su Oficina en el país reiteran su disposición para continuar apoyando a las autoridades estatales a cumplir con sus obligaciones y compromisos internacionales en materia de derechos humanos.
