VICTOR MURDER: TWO SA SUSPECTS FIGHT EXTRADITION

MBABANE – The two South African nationals suspected to have killed businessman Victor Gamedze are not prepared to come to Swaziland.


The duo, Mbusi Ncaza Nkosi and Siphiwe Ngubane, on Friday appeared at the Johannesburg Magistrates Court where they clearly stated their unwillingness to come to the country through their attorney.
It will seem the State will have an uphill battle as it is being met with resistance in its application for the extradition of the pair.    


Nkosi and Ngubane on Friday morning physically made an appearance at the court and their appearance was specifically for the extradition. The suspects are currently under provisional arrest following their apprehension about two weeks ago. Social Media, was already abuzz over the suspects appearance although most of the posts suggested that they did not have enough information on what went on in court.   
Their court appearance in South Africa comes after Swaziland, through the National Prosecuting Authority of South Africa (NPAS), filed an application for their extradition.


According to a source from the South African prosecuting authority, the suspects, through their attorney, told the court that they were opposing the application to be extradited to Swaziland.
Their attorney only filed a notice of intention to oppose.
Through their attorney, the suspects highlighted that they would soon be filing detailed papers outlining why they were opposing the application to be extradited to Swaziland. This resulted in the magistrate, who was presiding over the matter, postponing it to March 15, 2018.


 “On this day Swaziland, which is represented by Advocate Deon Van Vyk from the National Prosecuting Authority of South Africa, is expected to convince the court why the accused should be extradited,” said the South African source.
The source revealed that during the hearing, there was a Swazi delegation whose further particulars were unknown to her.
She highlighted that during their next appearance, the accused were also expected to argue why they should not be extradited to Swaziland to face the murder charge.
The accused were remanded in  custody until the aforementioned hearing date.


“Evidence will have to be led and the magistrate will have to decide,” the source added.
